By accessing or using Spictera AB's ("Spictera," "we," "our," or "us") website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services.
2. Description of Services
Spictera provides enterprise data protection solutions, including:
- Unified Storage (SPFS + SPIR): File system access, immutable snapshots, geo-fencing, and IBM Storage Protect integration
- Secure Workspace: Zero-leakage remote access and collaboration platform
- SIAA: Identity and Access Assurance with NIST 800-63 compliance
3. User Accounts and Registration
3.1 Account Creation
To access certain features of our services, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
3.2 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

5.2 Your Content
You retain ownership of any content you upload or store using our services. By using our services, you grant us a limited license to process, store, and backup your content as necessary to provide the services.
6. Payments and Billing
6.1 Fees
Certain services may require payment of fees. All fees are non-refundable unless otherwise stated. We reserve the right to change our pricing with 30 days' notice.
6.2 Payment Terms
Payment is due according to the billing cycle agreed upon in your service agreement. Failure to pay may result in suspension or termination of services.
7. Disclaimers and Limitations of Liability
7.1 Service Availability
We strive to provide reliable services but do not guarantee uninterrupted or error-free access. Services are provided "as is" and "as available" without warranties of any kind.
7.2 Limitation of Liability
To the maximum extent permitted by law, Spictera shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our services.
8. Indemnification
You agree to indemnify and hold harmless Spictera, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these Terms.
9. Data Protection and Privacy
Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to the practices described in the Privacy Policy.
10. Service Level Agreement (SLA)
For enterprise customers, specific service level commitments are outlined in your Service Level Agreement. Please refer to your SLA for details on uptime guarantees, support response times, and remedies.
11. Termination
11.1 Termination by You
You may terminate your account at any time by contacting us. Upon termination, your access to services will cease.
11.2 Termination by Us
We may terminate or suspend your access to services immediately, without prior notice, if you breach these Terms or for any other reason at our sole discretion.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.
Any disputes arising from these Terms or use of our services shall be resolved through binding arbitration in accordance with Swedish arbitration rules, or in the competent courts of Sweden.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through our website. Continued use of our services after changes constitute acceptance of the revised Terms.
